By Sara Sleyster October 12, 2009 The man suspected of hitting and killing a bicyclist near Cumming this summer avoided a scheduled court appearance this morning by filing a written plea last week. Paul L. McKinney, 79, of Winterset entered a written plea of not guilty to the charges of hit and run and obstructing prosecution. He also waived his right to a speedy trial. McKinney is accused of driving the truck that hit and killed bicyclist Mark Grgurich on Aug. 30 in Warren County. He was also charged with failure to maintain control following the incident. A pretrial hearing was set for 9:30 a.m. Nov. 17 at the Warren County courthouse. The trial was scheduled for 8:30 a.m. Dec. 3.
