Crawford County Rescinds RAGBRAI Ban

The Crawford County Board of Supervisors unanimously voted
Tuesday to rescind the ban on organized bike rides, like
RAGBRAI, in Crawford County. The Board of Supervisors first
discussed lifting the ban in September but tabled the
decision at that time.

After a 2004 accident resulting in the death of a RAGBRAI
rider, the rider's family sued the county alleging
negligence and the county's insurance carrier settled the
suit for $350,000 in 2007. The biking ban was instituted in
October of 2007 prohibiting RAGBRAI 2008 from traversing the
county.

Supervisor Dan Muhlbauer actively engaged other county
boards and petitioned the Iowa Legislature to amend the
bicycle use code releasing counties from liability for
incident that may occur. The change was not adopted.

However, RAGBRAI, the largest bike ride of its kind,
proposed to David Vestal, attorney for the Iowa State
Association of Counties, changes in its participation waiver
releasing local governments from liability.

Because not all participants sign waivers, RAGBRAI will also
purchase a $2 million insurance policy. Since the insurance
policy covers participants not already covered by the
waiver, Crawford County's concerns are satisfied.

Muhlbauer commented, "That's what we really wanted."

While they weren't specifically asked to lift the ban,
Muhlbauer continued that the county hopes to "put a positive
foot forward."

County engineer Paul Assman, stated, "We don't want anyone
to get hurt."

To this end the county has ordered and will use movable
warning signs on routes used by bike rides. Assman explained
that the signs warn riders that characteristics common in
normal highway construction, such as the centerline seam or
rumble strips, are present and may be hazardous to bicycle
riders.
